Thailand SEC Draft Rules for Spot Bitcoin and Ethereum ETFs

Share:

Thailand’s Securities and Exchange Commission has released draft rules that would clear a path for spot Bitcoin and Ethereum ETFs to trade on the country’s stock exchange, a regulatory opening that would give local investors exchange-listed exposure to the two largest crypto assets for the first time.

What Thailand’s SEC Draft Rules Would Allow

The proposal comes directly from Thailand’s SEC, the country’s securities regulator, in a newly published draft notification. It remains a draft rather than a finalized framework, meaning nothing is yet approved for launch.

At its core, the draft would permit spot Bitcoin ETFs and spot Ethereum ETFs, products that hold the underlying assets directly rather than derivatives, to list and trade on the stock exchange. Reporting on the proposal notes the rules would require these funds to maintain at least 80% exposure to their target crypto asset.

Why the Proposal Matters for Thailand’s Crypto Market

The significance is structural: routing crypto exposure through a regulated stock exchange venue lets investors gain access to Bitcoin and Ethereum using familiar brokerage infrastructure rather than unregulated venues. That matters for both institutional and retail participants who have been limited in how they can hold digital assets within a supervised framework.

By naming both Bitcoin and Ethereum, the draft signals coverage of the two largest crypto assets rather than a single-asset pilot. A securities regulator formally proposing spot ETF rules makes this a meaningful step in Thailand’s evolving digital asset regulation. Still, the rules are only in draft form, and a proposal is not an approval.

What to Watch Next in the ETF Rulemaking Process

Draft rules of this kind typically move into a consultation stage, where issuers, brokers, and other market participants can submit feedback before any revisions or final adoption. The timeline for a final rule remains uncertain.

Beyond regulatory sign-off, exchange-traded products depend on listing mechanics, so the practical arrival of any fund would hinge on implementation details on the exchange side. For issuers weighing entry and investors watching for access, the next concrete signals will be the close of any feedback window and the publication of a finalized notification.
